FlixFox Copyright Removal Policy: 3-Strike Rule for Streaming Links
Last updated:
FlixFox operates as a high-velocity navigational resource and an automated link-indexing utility. Our platform functions as a secondary content gateway, organizing digital pointers to media that is already publicly accessible across the global web. We do not possess, transmit, host, or archive physical video files or live streams on our proprietary infrastructure. All media discovered through our interface remains stored on third-party servers that operate entirely independently of FlixFox.
1. Recognition of Intellectual Property
We hold the utmost respect for the creative industries within India and the international media landscape. FlixFox is dedicated to honoring the legal rights of all intellectual property stakeholders, with a specific focus on major Bollywood studios, regional South Indian production houses (Tollywood, Kollywood, etc.), and sports organizations managing events like the IPL and ICC tournaments.
In accordance with the Copyright Act, 1957 of India and the global standards set by the Digital Millennium Copyright Act (DMCA), we provide a structured framework for rights holders to report infringing search results. As a digital intermediary under Section 79 of the Information Technology Act, 2000, we act with due diligence to de-index unauthorized content once a legitimate legal notice is verified.
2. Requirements for a Valid Takedown Notice
To submit an actionable claim for the removal of a specific indexed entry, the copyright proprietor or their certified agent must provide a formal written communication. Under Indian and international law, your report must include:
- Signature of Authority: A physical or electronic signature from the copyright owner or a representative legally empowered to act on their behalf.
- Identification of the Work: Precise details regarding the copyrighted material alleged to be infringed (e.g., the title of the film or series, episode number, or sporting event broadcast).
- Technical Link Evidence: The exact search result URL or technical pointer within the FlixFox app that facilitates access to the external host.
- Direct Contact Information: Your full legal name, physical business address, telephone number, and official corporate email address.
- Good-Faith Affirmation: A statement declaring that the use of the material is not authorized by the owner, their agent, or the prevailing law.
- Perjury Statement: A declaration that the information provided is accurate and that you are the rightful owner of the exclusive right being asserted.
3. Defense of Fair Dealing & Counter-Notices
If a service provider or user believes a link was mistakenly purged from our directory due to a technical error, they may submit a Counter-Notification. Under the Copyright Act, 1957, Indian law recognizes "Fair Dealing" for purposes such as news reporting, criticism, or educational commentary.
Your counter-notice must include your identity, the specific link removed, and an affirmation that the removal resulted from misidentification. FlixFox reserves the right to review these submissions and may restore the index entry if legal Fair Dealing criteria are clearly established.
4. Repeat Infringer Protocol: The 3-Strike Rule
To ensure a clean indexing environment, FlixFox enforces a strict escalation protocol for third-party domains that consistently provide unauthorized content:
- Strike 1 (Warning): Upon the first validated report, the infringing result is removed and the source domain is flagged in our internal database.
- Strike 2 (Suspension): Continued indexing of unauthorized material from the same source results in a 30-day suspension of all results from that domain.
- Strike 3 (Permanent Ban): Persistent or systemic violations lead to the total and permanent removal of the source domain from the FlixFox search database.
5. Submission Procedures
All legal notices should be directed through our official website's contact portal. We acknowledge most valid takedown requests within 24 hours and typically finalize the removal of infringing search entries within two business days.
